In Kocur v Angard Staffing Solutions Ltd UKEAT/0181/17 the EAT held that a failure to provide an agency worker with the same annual leave entitlement and paid rest breaks as those enjoyed by the hirer’s permanent employees could not be compensated for by an enhanced hourly rate of pay.
