Court's power to make orders for disclosure of information and for party's surrender of passport pending compliance (High Court)

In Corbiere Ltd and others v Xu and Secretary of State for the Home Department (Intervener) [2018] EWHC 112 (Ch), the court considered two applications by the claimants in proceedings arising out of the misappropriation by the defendant, Mr Xu, of confidential information belonging to the claimants. They comprised an application for disclosure regarding confidential information wrongly accessed and copied and an application for an order that the defendant surrender his passport until after the disclosure was provided or after trial of the proceedings. The claimants also sought a declaration that the orders, if made, would engage the claimants’ Article 6 rights, and action by the Home Office to deport Mr Xu would infringe those rights.
